High Court Bars Government From Proceeding With Ebola Quarantine Facility in Laikipia

The High Court has issued conservatory orders restraining the Government from establishing Ebola quarantine facility in Kenya after the State failed to file responses or appear in court.

In its ruling on Tuesday, the Court further prohibited the admission, transfer, receipt, or facilitation of entry into Kenya of persons exposed to or infected with Ebola under the disputed arrangement, pending the hearing and determination of a constitutional petition.

“The High Court has granted conservatory orders restraining the Government from establishing, operationalising, facilitating, approving, or permitting any Ebola quarantine, isolation, exposure, or treatment facility in Kenya pursuant to the challenged arrangement with the United States or any other foreign government pending the hearing and determination of the petition,” Katiba Institute confirmed.

The Court also directed the respondents to disclose all agreements, negotiations, approvals, risk assessments, and operational protocols relating to the proposed facility within seven days.

According to the petitioner, Katiba Institute, the orders are intended to preserve the status quo and prevent irreversible actions before constitutional scrutiny is undertaken.

Katiba Institute filed a petition on May 29 challenging an alleged agreement between Kenya and the United States to establish a 50-bed Ebola quarantine facility at Laikipia Air Base.

It argued that the arrangement was negotiated without public participation, and raises concerns over biosecurity, national sovereignty, and constitutional governance.
