Former Mathioya MP Francis Githiari Arrested Over Alleged Sh6.4 Million Land Fraud

Detectives from the Directorate of Criminal Investigations (DCI) Land Fraud Investigation Unit have arrested former Mathioya Member of Parliament Francis Njakwe Githiari over allegations of defrauding a couple Sh6.4 million in a disputed land and construction deal.

According to investigators, the complainants entered into an agreement with Githiari for the purchase of a parcel of land in Ngong, alongside the construction of a double-storey residential house.

In the arrangement, Githiari presented himself both as the land vendor and the contractor overseeing the project.

The total cost of the project was set at Sh40 million, payable in instalments. The couple reportedly paid an initial Sh6.4 million into his account as part of the agreement.

However, concerns emerged after the couple learned of an ongoing ownership dispute over the property, with competing claims filed by other parties. This development prompted them to suspend further payments and report the matter.

A subsequent investigation by the DCI established that the funds were allegedly obtained through false pretences.

The findings were forwarded to the Office of the Director of Public Prosecutions (ODPP), which approved charges against the former legislator.

The ODPP agreed with investigators’ recommendation to charge Githiari with obtaining money by false pretences, contrary to Section 313 of the Penal Code.

He was arrested at his Karen residence and remains in custody, pending arraignment at the Milimani Law Courts. He is expected to appear in court today, May 15, 2026, as legal proceedings commence.
