The High Court has ordered Muthaiga Country Club to pay lawyer Donald Kipkorir a Ksh1 million compensation, for denying him access to the facility.

In a judgement delivered by Justice Chacha Mwita, Muthaiga Country Club violated Kipkorir’s constitutional rights by refusing his entry, even though he was invited by a member.
Justice Mwita directed the country club to compensate Kipkorir with Ksh1 million in damages, along with covering legal costs.
The renowned lawyer took to his X account to celebrate the ruling and commended Justice Mwita for upholding justice and ensuring accountability.
“Hon. Justice Chacha Mwita delivered judgement on my Constitutional Petition against Muthaiga Country Club that had refused me entry on the most spurious grounds,” Kipkorir wrote on X.
“Justice Chacha Mwita who is one of our finest Judges in mind & character held that MCC violated my Constitutional Rights & that they can’t refuse me entry if I am invited by a Member.”
He also criticized the country club for instituting “blackballing” policies that bar specific people from gaining access or becoming members.
“Muthaiga Country Club should end its “blackballing” policy where members with personal vendetta are allowed to anonymously stop a guest from coming or from even becoming a member! An accuser must be man enough to one out instead of hiding in shadows like a weasel,” he said.
According to lawyer Peter Wanyama, Donald Kipkorir was on August 9,2024, invited by a client who is a member of Muthaiga Country Club, to take instructions in a case. He was however turned away by security officials, who did not provide him with any explanation.
“Besides, when they asked Donald to leave the premises, the Club security ‘treated’ him like a stray dog, a homeless hound that had crushed the hallowed grounds of the privileged elite. He instructed me to sue the Club,” Wanyama said.
