In a significant victory for child protection and justice, the Director of Public Prosecutions (DPP) has secured two life imprisonment sentences against separate offenders in cases involving sexual violence against minors.

The sentences were delivered by the Makindu Law Courts in judgments handed down on February 19, 2026.
In the first case, Senior Resident Magistrate Hon. Kibe sentenced Nicholas Kioko to life imprisonment after finding him guilty of defiling a 10-year-old minor, contrary to Section 8(1) as read with Section 8(2) of the Sexual Offences Act No. 3 of 2006. Under Kenyan law, defilement of a child aged 11 years and below attracts a mandatory life sentence.
The court heard that the offence was discovered through a school-based initiative aimed at encouraging learners to anonymously disclose challenges affecting their well-being. The victim’s written account prompted swift investigations, leading to Kioko’s arrest and subsequent prosecution.
During his trial, the Prosecution presented compelling and consistent evidence, including the victim’s testimony and corroborative material that firmly placed the accused at the scene of the crime. The court found the evidence credible and sufficient to sustain a conviction.
In the second case, Dominic Mwilu Ndungu was convicted of incest, contrary to Section 20(1) of the Sexual Offences Act.
The victim, a seven-year-old relative, suffered prolonged sexual abuse at the hands of the accused.
Despite Ndungu’s denial and claims that he has been falsely accused, the Prosecution dismantled his defence through detailed medical findings and witness testimony, conclusively linking him to the offence.
The court ruled that all elements of the charge had been proved beyond reasonable doubt and sentenced him to life imprisonment, as required where the victim of incest is a minor.
Mr. Wilberforce Odhiambo prosecuted both cases, meticulously presenting evidence and guiding witnesses through the trial process, ensuring that justice was served.
The twin convictions send a strong warning to perpetrators of sexual crimes against children that such acts will attract the full force of the law.
The DPP reaffirmed its unwavering commitment to safeguarding the rights of minors, prosecuting offenders vigorously, and supporting survivors through the justice system.
These rulings highlights Kenya’s firm stance against sexual exploitation and reinforce the country’s legal framework in protecting children from abuse, neglect, and violence.
